When you engage with our Services, you retain complete ownership of all data you provide to us. This includes datasets, documents, customer information, or any other content shared for the purpose of training, integration, deployment, or consulting. We will never claim ownership of your proprietary datasets unless a separate written agreement is made as part of a custom project.

By submitting data, you grant Globussoft.ai a limited, non-exclusive license to use the information solely to deliver the Services you have contracted. AI-generated outputs are probabilistic in nature. Globussoft.ai cannot be held responsible for damages, losses, or negative outcomes arising from sole reliance on AI-generated outputs. The responsibility for verifying accuracy, relevance, and appropriateness of the outputs before applying them in production remains with you, the client.

10. Payment, Fees, and Subscriptions

Certain Services offered by Globussoft.ai, including but not limited to consulting, AI integration, data processing, and software licenses, may be provided on a subscription, project-based, or license fee structure.

  • Payments must be made according to the terms specified in your order confirmation, service agreement, or invoice.
  • Fees are generally non-refundable, except where explicitly stated in writing. For example, in cases of service-level failures explicitly guaranteed in your contract, a refund or service credit may apply.
  • Late, partial, or failed payments may lead to suspension or termination of Services. Globussoft.ai reserves the right to restrict access until payments are cleared.

All financial obligations, including taxes, charges, and transaction fees, are the client’s responsibility unless otherwise agreed. Continued use of our AI-driven Services requires compliance with these payment terms to ensure uninterrupted delivery.

11. Third-Party Tools and Integrations

To deliver powerful and scalable AI solutions, Globussoft.ai may integrate its Services with third-party APIs, Large Language Models (LLMs), cloud providers, and other software tools.

While these integrations enhance functionality and efficiency, it is important to note that Globussoft.ai does not control or guarantee the accuracy, reliability, or availability of third-party services. Termination does not relieve you of financial obligations incurred before suspension or cancellation.

13. Warranties & Disclaimers

Globussoft.ai provides its Services strictly on an “as is” and “as available” basis. While we employ advanced technologies and best practices, we cannot guarantee absolute perfection or uninterrupted service.

We make no warranties that:

  • AI models will always generate error-free, unbiased, or completely accurate results.
  • Services will be uninterrupted, timely, or free from technical issues.
  • Third-party integrations, APIs, or LLMs will remain compatible or available indefinitely.

You expressly agree that the use of our AI-powered Services is at your sole risk. Globussoft.ai disclaims liability for issues, including but not limited to reliance on AI-generated outputs, downtime, third-party service failures, or unexpected system behavior.

14. Limitation of Liability

To the maximum extent permitted by law, Globussoft.ai shall not be liable for indirect, incidental, or consequential damages. 16. Confidentiality & Non-Disclosure (Enterprise Clients)

Globussoft.ai understands the critical importance of confidentiality when handling enterprise projects involving AI development, data engineering, and consulting engagements. Both parties agree to uphold strict confidentiality standards regarding sensitive information shared during the course of collaboration.

16.1 Definition of Confidential Information

  • Confidential information includes, but is not limited to, business strategies, technical documents, proprietary datasets, algorithms, financial details, trade secrets, and project roadmaps exchanged between the parties.

16.2 Non-Disclosure Obligations

  • Neither party shall disclose, share, or disseminate confidential information to any third party without prior written consent, unless disclosure is mandated by applicable law, court order, or regulatory authority.
  • Confidentiality obligations remain binding even after the termination of the project or contract.

17. Compliance & Responsible AI Use

  • Ensure that AI applications built or deployed using Globussoft.ai’s technology comply with applicable data protection laws, consumer protection regulations, intellectual property laws, and export restrictions.

17.2 Ethical Standards

  • You must not use our AI Services in ways that promote misinformation, violate human rights, enable surveillance without consent, or compromise safety.
  • Restricted use cases include, but are not limited to:

    • Development of autonomous weapons.
    • Unauthorized biometric surveillance.
    • Creation of deepfakes or impersonation tools without consent.
    • Use of AI for discriminatory practices.

17.3 User Responsibility

18. Governing Law & Dispute Resolution

18.1 Applicable Law

  • These Terms are governed and interpreted in accordance with the laws of India, without regard to conflict of law provisions.

18.2 Jurisdiction

  • Any legal disputes shall fall under the exclusive jurisdiction of the courts in Bengaluru, India.

18.3 Dispute Resolution Process

  • Before initiating formal litigation, both parties agree to make reasonable efforts to resolve disputes through good-faith negotiation or mediation.
  • Mediation allows for a collaborative and less adversarial approach to resolving disagreements, especially relevant in complex AI-related projects where technical clarification may be required.

By accepting these Terms, you acknowledge that disputes will be handled fairly and transparently, with legal recourse available only after attempts at amicable resolution.

19. Severability

If any provision of these Terms is found to be invalid, unenforceable, or contrary to law by a court of competent jurisdiction, such provision shall be severed. The remainder of the Terms will continue in full force and effect.

This ensures that the validity of the agreement is preserved even if one section becomes unenforceable. It also reinforces that each clause of the Terms stands independently to maintain the overall enforceability of our agreement.

20. Entire Agreement

This agreement supersedes any prior negotiations, proposals, or oral/written communications. No verbal or informal assurances shall be binding unless incorporated into a signed contract.
